We trigger OHS investigation of Victorian Covid-19 hotel quarantine mess

Yesterday we wrote to the Victorian WorkCover Authority requesting them to investigate the Covid-19 hotel quarantine mess for possible breaches under the Victorian work safety laws (Occupational Health & Safety Act). Section 131 of the Act allows us to lodge such a request on the Authority who, under the Act must investigate and respond.

The Victorian government has pretty much admitted that the second Covid-19 wave outbreak happened because of the botched hotel quarantine mess in March. Hundreds of deaths have occurred following this.

If anything like this sort of scenario had happened in a private-sector business, we could be sure that a massive investigation would be undertaken by the Victorian WorkCover Authority. The investigation would look to see if prosecution should occur under the Victorian OHS Act, including application of the new manslaughter provisions. Last week (22 July) the Morrison government announced that JobKeeper and JobSeeker are being extended past the current cut-off of at the end of September. But there are changes to eligibility and the amounts being paid.

Last week, we reported the release by the ATO of threats to treat people who’ve accessed JobKeeper (and other programs) of being tax fraudsters. The problem, we say, is the ability of the ATO’s auditors to apply their ‘view’ as to fraud, which then becomes ‘fact’ at law, subject to prosecution. We can’t believe that, for all the great work the ATO has done with implementing the Covid-19 support packages, it's decided to blow up that good work.

Last week (23 June) the ATO released a statement ‘ATO zeroes in on COVID-19 fraud’.
